Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Jiskta Climate Data API and website (collectively, the "Service") operated by Jiskta ("we", "us", or "our"). By creating an account, purchasing credits, or making any API call, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Jiskta provides a programmatic API and related applications that query and join multiple open scientific datasets (atmospheric reanalysis, meteorological reanalysis, nighttime lights, land cover, socioeconomic indicators, and others), delivered in processed form via a proprietary query engine. The current dataset catalogue, including spatial and temporal coverage for each source, is maintained at jiskta.com/coverage. New datasets may be added at any time without requiring an update to these Terms.
Geographic Restriction: The Service is strictly limited to individuals and legal entities located or incorporated within the European Union (EU). The Service is explicitly not intended for, nor available to, users located in the United States of America, Canada, or any other region outside the EU. By using the Service or purchasing credits, you represent and warrant that you are located within the EU.
2. Data Accuracy and Disclaimer
You acknowledge and agree that:
- Reanalysis data is a modelled estimate of historical atmospheric conditions, not a direct measurement. It inherits the uncertainties, spatial resolution limits (0.1° ≈ 11 km), and temporal resolution limits (hourly) of the underlying CAMS model.
- Our query engine spatially sub-selects and decompresses tile data. While we take care to ensure correctness, query results may contain inaccuracies arising from software defects, tile encoding errors, boundary rounding, or incomplete data coverage.
- We make no warranty, express or implied, regarding the accuracy, completeness, fitness for a particular purpose, or reliability of any data returned by the API.
- Data should not be used for: environmental compliance filings, medical or clinical decisions, aviation or navigation, emergency response, or any application where inaccurate values could cause harm or legal liability.
- We provide no guarantee that data coverage is complete for any given geographic region or time period.
3. Data Source Attribution
The Jiskta API integrates data from multiple open-licence third-party sources. Each source has its own attribution requirements, which are documented on the Coverage page alongside the applicable licence for each dataset.
When publishing, redistributing, or commercialising results derived from the Jiskta API, you are responsible for complying with the attribution requirements of every data source used in your query. At minimum this means crediting the original data provider and licence (e.g. "Data sourced from Copernicus CAMS / World Bank Open Data / NASA VIIRS, licensed under [applicable licence]"). The Coverage page is the authoritative reference for per-source attribution text and licence terms.
These attribution obligations pass through to you as a condition of your use of the Jiskta API and cannot be waived by Jiskta.
4. Acceptable Use
You may use the Service for any lawful purpose, subject to these restrictions. You must not:
- Redistribute raw API output as a standalone data product or data feed that competes with Jiskta or the Copernicus data programme;
- Use the Service to circumvent, scrape, or systematically archive the entire dataset for purposes other than your own analysis;
- Attempt to reverse-engineer the tile file format or the query engine binary beyond what is permissible under applicable law;
- Share, sell, or transfer your API key to any third party;
- Use automated tooling to hammer the API in ways that degrade service for other users (the adaptive throttling will return
HTTP 429, but deliberate abuse may result in account termination); - Use the Service to process data in violation of any applicable privacy or export-control law.
5. Credits, Payments, and Refunds
- The Service operates on a prepaid credit model. Credits are purchased in fixed packages (Starter, Professional, Enterprise) via Paddle, our payment processor and Merchant of Record.
- Paddle is the Merchant of Record for all transactions. Your payment contract is with Paddle.com Market Limited. Paddle handles VAT collection and remittance on our behalf. A Paddle invoice is issued automatically after each purchase and sent to your email address.
- Credits are deducted per query based on the number of geographic regions, time months, and pollutants queried.
- Credits do not expire.
- Right of withdrawal — waiver. The Service is a digital service that begins performance immediately upon purchase. By confirming a purchase you expressly consent to immediate performance and acknowledge that you thereby lose your 14-day right of withdrawal under Article 16(m) of the EU Consumer Rights Directive (2011/83/EU). A confirmation of this waiver is shown to you before each purchase.
- All purchases are final. We do not offer refunds on purchased credit packages, whether or not the credits have been consumed, except where required by applicable mandatory consumer protection law that cannot be waived.
- If you believe credits were deducted in error, contact us at [email protected] within 30 days. We will investigate and, if we caused the error, restore the affected credits. We do not offer cash refunds for disputed credit deductions.
- Prices are shown in Euros (EUR). VAT is calculated and collected by Paddle based on your billing country. Business customers in the EU may provide a valid VAT number for reverse-charge treatment.
- We reserve the right to change pricing at any time. Price changes do not affect already-purchased credits.
6. Accounts and API Keys
- You are responsible for keeping your API key confidential. Treat it like a password.
- Any API calls made with your key are your responsibility, regardless of whether you authorised them.
- If you believe your key has been compromised, regenerate it immediately via the dashboard.
- You must provide accurate information when creating your account. One account per person or legal entity.
7. Service Availability
We aim to keep the Service available at all times but provide no uptime guarantee or SLA. The Service may be interrupted for maintenance, security patches, or reasons beyond our control (hardware failure, upstream provider outage, etc.). We are not liable for losses arising from periods of unavailability.
8. Limitation of Liability
To the fullest extent permitted by applicable law:
- The Service is provided "as is" and "as available", without warranties of any kind.
- In no event shall Jiskta, its operators, or contributors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or reputational harm, arising out of your use of or inability to use the Service or the data it provides.
- Our total aggregate liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total amount you paid us in the 12 months preceding the claim.
- This limitation applies even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the minimum extent permitted by law.
9. Indemnification
You agree to indemnify and hold harmless Jiskta and its operators from any claim, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your use of the Service in violation of these Terms; (b) your violation of any third-party rights; or (c) any decisions you make based on data returned by the API.
10. Intellectual Property
The Jiskta query engine, tile format, website, and API design are proprietary. Nothing in these Terms grants you any licence to the underlying software or infrastructure. The underlying atmospheric data is subject to the Copernicus licence (see Section 3).
11. Termination
We may suspend or terminate your account at any time for material breach of these Terms, illegal use, abuse of the API, or non-payment of chargebacks. On termination, unused credits are forfeited unless termination was caused by our error, in which case we will refund unused credit value at the applicable package rate.
You may close your account at any time by contacting [email protected]. Unused credits are non-refundable on voluntary account closure.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified by email to the address on your account at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
13. Governing Law and Disputes
These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Any dispute that cannot be resolved informally shall be submitted to the exclusive jurisdiction of the courts of Belgium. If you are a consumer in the EU, you retain any mandatory protections granted by the laws of your country of residence.
